Most Indian rental agreements run for 11 months to avoid mandatory registration, but a well-drafted agreement protects both sides regardless of length.
Clauses that matter
- Rent, due date, and annual escalation (5–10% is typical).
- Security deposit amount and the refund timeline after vacating (specify deductions allowed).
- Lock-in period and notice period for both sides.
- Who pays maintenance, water, electricity and society charges.
- Permitted use (residential only), sub-letting, pets, and number of occupants.
- Repairs: minor by tenant, structural by owner.
- An inventory of fittings and furniture with photos attached.
Stamp duty and registration
Stamp duty on rental agreements varies by state (Maharashtra and Karnataka have e-stamping; Tamil Nadu uses e-registration for leases over 11 months). Agreements longer than 11 months must be registered at the sub-registrar office. Police verification of tenants is required in many cities and is usually the owner's responsibility.
